Terms of Use

These Terms of Use (the “Terms”) govern access to and use of the Bambinoushmobile app (the “app”, the “platform”). Bambinoush connects parents and babysitters. By creating an account or using the app, you confirm that you have read and accepted these Terms. Access is reserved for adults aged 18 and over, whether parents or babysitters.

1. Publisher and contact

2. What the service is

Bambinoush is a technical platform that connects people. It lets parents find babysitters, and babysitters offer their services.

Bambinoush is not an employer, not a placement agency, and not a party to the babysitting agreement. The platform only makes the introduction: the babysitting agreement is formed directly between the parent and the babysitter, who alone set its terms (hours, tasks, pay). The platform plays no part in performing that agreement and does not supervise any babysitting.

3. Accounts

  • Registration is open to people aged 18 and over, whether parents or babysitters. No account may be created by a minor.
  • Your date of birth is requested at sign-up and your age is verified: registration is refused below 18. Declaring an inaccurate date of birth is a breach of these Terms and leads to the account being closed.
  • One person may hold only one account. Multiple or fraudulent accounts are prohibited.
  • You undertake to provide accurate, current and complete information, and to update it when it changes.
  • You are responsible for keeping your credentials confidential and for all activity carried out from your account. Tell us immediately if it is used without your authorisation.

4. What the “verified” badge means, and what it does not

The “verified profile” badge attests to one thing only: the person presented an official identity document, and an automated check found that their face matches the one on the document. This verification is optional and carried out by a specialist provider.

This badge is not a criminal background check. It says nothing about a person’s criminal record, integrity, skills, experience or behaviour. The platform performs no check of that kind and issues no such certificate.

Choosing a babysitter, and deciding to entrust a child to them, is the parent’s decision alone. It is for the parent to carry out their own checks: interview, references, documents, trial period.

5. Parents’ obligations

  • Give the babysitter accurate and complete information about the children: age, allergies, treatments, particular needs, instructions.
  • Stay reachable and leave a working means of contact for the whole duration of the babysitting.
  • Provide a safe environment suited to caring for the child.
  • Pay the babysitter the agreed amount, in the way the parties decided.
  • Only add a photo of a child if you hold parental authority and, where applicable, the other parent consents.

6. Babysitters’ obligations

  • Provide a profile and documents that are accurate, current and truthful.
  • Keep to the agreed hours and be punctual.
  • Never leave the child unattended, and keep them safe at all times.
  • Immediately tell the parent about any problem, incident or unusual situation during the babysitting.
  • Do not share or keep photos and information about the children beyond what the babysitting requires.

7. Payments

Babysitting is paid directly between the parent and the babysitter (via Bit, Paybox or any other means they agree on), outside the platform. Bambinoush does not collect babysitting fees and takes no part in those payments.

Premium subscriptions and paid options in the app are purchased through Apple’s App Store or Google Play. Billing, renewal and cancellation are handled by your Apple or Google account, under that store’s rules.

Cancelling a subscription: a subscription can be cancelled at any time from your Apple or Google account settings, without contacting us and without penalty. Cancellation takes effect at the end of the period already paid for. Refund requests are handled by the store where the purchase was made. These terms apply without prejudice to your rights under Israeli consumer protection law.

8. Incidents during a babysitting

  • In an emergency: call the Israeli emergency services immediately — Magen David Adom on 101 and the Police on 100 — then tell the parent.
  • Liability for an incident during a babysitting lies with the parties to the babysitting agreement, namely the parent and the babysitter, under applicable law. The platform is not a party to that agreement.
  • Any significant incident must be reported to the platform within 48 hours atcontact@bambinoush.com. Following a report, the platform may suspend or remove an account, and it cooperates with the competent authorities upon lawful request.
  • Insurance: the platform insures neither parents nor babysitters. Parents are advised to check their liability and home insurance cover, and babysitters to hold professional liability insurance.

9. Content and behaviour

  • Listings, profiles and reviews must be truthful and reflect reality. A review may only be left after a babysitting that actually took place.
  • The following are prohibited: unlawful, misleading or defamatory content, and content that infringes the rights of others.
  • Circumventing the platform in order to escape its rules is prohibited.
  • Harassment, threats and any abusive behaviour towards another user are prohibited.
  • Every profile and every listing has a menu to report content or block a user. Reports are reviewed and may lead to an account being suspended.

10. Personal data

How we process your personal data is described in ourPrivacy Policy, which forms an integral part of these Terms.

Photos of children are added voluntarily by the parent holding parental authority, under their responsibility. They are visible only to babysitters who have applied to that parent’s listing or are linked to them by a babysitting request, and the parent can remove them at any time.

11. Liability

The platform provides an introduction service. It is not a party to the babysitting agreement and is therefore not liable for its performance or non-performance, nor for the acts or omissions of users towards each other.

To the extent permitted by law, the platform is liable for direct damage resulting from a breach of its own obligations.Nothing in these Terms excludes or limits the platform’s liability for bodily injury, wilful misconduct or gross negligence, or in any case where Israeli law prohibits such a limitation.

These Terms constitute a standard-form contract within the meaning of the Israeli Standard Contracts Law, 5743-1982. Should any clause be held unfair or void, it shall be deemed not written, without affecting the validity of the remaining clauses.

12. Suspension and termination

You can delete your account at any time from the app, under Profile → Delete my profile.

The platform may suspend or terminate an account in the event of a breach of these Terms, abusive behaviour or fraudulent use of the service. Except in an emergency or where the law requires otherwise, the suspension is explained and you can challenge it atcontact@bambinoush.com.

13. Changes to these Terms

These Terms may be amended to reflect changes to the service or to the applicable regulations.

A material change — one that affects your rights, your obligations or the price — will be notified to you in the appat least 14 days before it takes effect. If it does not suit you, you may close your account free of charge before that date; for a subscription already running, the change does not apply to you before its expiry. Minor changes (wording corrections, clarifications) take effect on publication.

14. Governing law and jurisdiction

These Terms are governed by Israeli law. Any dispute concerning their validity, interpretation or performance falls within the jurisdiction of the courts of Tel Aviv-Jaffa, without prejudice to the mandatory jurisdiction rules a consumer benefits from under the law.
